The Dowry Prohibition Act, 1961
This law prohibits the request, payment or acceptance of dowry, which is taken “with reference to marriage”. Here “dowry” is defined as a gift given as a precondition for marriage. Gifts given unconditionally are not considered dowry, and are not legally an offense.
Dowry and Indian Penal Code
Apart from the Dowry Prohibition Act 1961, the threat of dowry is included in the Indian Penal Code.
1. Section 304-B {Dowry Death} and
2. Section 498-A {Cruelty based on demand for dowry}.
